GERMANY: Children's rights and the European human rights system

Germany is a member of the Council of Europe and subject to the jurisdiction of the European Court of Human Rights, which issues decisions that are binding on all Council of Europe members. The Court maintains a searchable database of its case law (http://www.echr.coe.int/ECHR/EN/Header/Case-Law/Hudoc/Hudoc+database/), and the Council of Europe's Theseus project also offers a database containing Court case law relevant to children's rights (http://www.coe.int/t/transversalprojects/children/caselaw/caselawchild_EN.asp).

European Court of Human Rights

Cases concerning children's issues in Germany which have been brought before the European Court have dealt with: parental access and custody rights, the legal status of children born out of wedlock, Fairness of the proceedings relating to accusations of sexual abuse against children and the taking of children into care.
