Children's Ombudsperson

The Irish Ombudsman for Children was established by the Ombudsman for Children Act of 2002, and has powers which include the ability to investigate complaints made by, or on behalf of, children. In its 2012 Concluding Observations, the Committee on the Rights of the Child expressed concern, however, about limitations on the Ombudsman's powers in relation to children in prisons and police stations. The Committee recommended that the State propose amendments to the relevant provisions which limit the scope of the investigative powers of the Ombudsman's Office "with a view to eliminating possible gaps which may result in the violation of children's rights". The Committee also encouraged the State to increase the independence of the Office by seeking a means to fund it directly through the Parliament and Department of Finance.
