Children's Ombudsperson Guatemala's Office of the Human Rights Procurator houses a Children's Ombudsman with the power to investigate complaints alleging violations of human rights. Where it appears that the violations alleged are in contravention of the criminal law, the Ombudsman is also authorised to refer the case to the Public Prosecutor's Office to initiate legal proceedings. However, the Committee on the Rights of the Child expressed concern at the “insufficient resources allocated to the Office of the Ombudsman, which impedes it form adequately fulfilling its functions.” The Committee also noted troubling reports of political bias, lack of attention to monitoring and preventative work, and failure to follow-up on detected violations.
