Children's Ombudsperson

An Ombudsperson was established under Law 10.683/03. The 152 ombudsperson's offices are not independent, however; rather, they are appointed by the executive as a communications mechanism between citizens and Government bodies. As such, the Committee on the Rights of the Child in its 2004 Concluding Observations expressed concern at the absence of an independent mechanism in compliance with the Paris Principles, with a mandate to regularly monitor and evaluate progress made in implementing the Convention on the Rights of the Child. The Committee recommended that the State create such a body empowered to receive and address individual complaints, including from children in a child-friendly and expeditious manner.
