AUSTRIA: Children's rights and the European human rights system

Summary: This report summarises the status of children's rights in Austria vis-a-vis European human rights mechanisms.

Austria is a member of the Council of Europe and subject to the jurisdiction of the European Court of Human Rights, which issues decisions that are binding on all Council of Europe members. The Court maintains a searchable database of its case law (http://www.echr.coe.int/ECHR/EN/Header/Case-Law/Hudoc/Hudoc+database/), and the Council of Europe's Theseus project also offers a database containing Court case law relevant to children's rights (http://www.coe.int/t/transversalprojects/children/caselaw/caselawchild_EN.asp).

European Court of Human Rights

Cases brought before the Court concerning children's issues in Austria deal with: differences in the minimum age for lawful homosexual and heterosexual relations, application of immigration rules, international child abduction, issues concerning children in care, the legal status of unmarried mothers and children born out of wedlock and custody issues.
