19 Janvier 2006 Nous, les organisations et personnes engagées dans la protection des droits de l'Homme sous-signées, avons observé de près les discussions visant à la création d'un Conseil des droits de l'Homme aux Nations unies, tel que proposé par le Secrétaire général et accepté par les chefs d'Etat en septembre 2005. Seul un Conseil des droits de l'Homme qui se construira sur les succès de la Commission des droits de l'Homme, renforcera la stature des droits de l'Homme au travers du système des Nations unies, et représentera une réelle valeur ajoutée par rapport à l'actuelle Commission, aura le soutien des organisations de droits de l'Homme et des autres organisations que nous sommes et, de manière plus importante, répondra aux espoirs des acteurs des droits de l'Homme de part le monde.

Alors que les négociations reprennent du 11 au 16 janvier 2006 (dans l'espoir de l'adoption d'une résolution finale), nous vous écrivons afin de vous faire part des éléments que nous pensons être absolument essentiels pour que la création d'un nouveau Conseil des droits de l'Homme soit un progrès par rapport à la Commission des droits de l'Homme existante.
Un grand nombre d'avancées sont reflétées dans le projet de résolution présenté par les deux co-Présidents datant du 19 décembre 2005. Les éléments suivants, qui sont inclus comme texte non-soumis à discussion, sont d'une importance centrale pour nous et doivent être maintenus:
Par ailleurs, trois autres questions imporantes sont encore “entre crochets” et doivent faire l'objet d'une négociation. Les choix retenus à l'issue de la négociation sur ces question seront déterminants pour faire que le nouveau Conseil aura organe avec un mandat renforcé de protection des droits de l'Homme par rapport à la Commission, ou à l'inverse, un mandat plus faible.
Une réforme qui renforce le respect des droits de l'Homme et démontre l'engagement de votre gouvernement pour les droits de l'Homme apportera du crédit aux Nations unies, ainsi qu'à nous tous qui travaillons à la création de ce Conseil des droits de l'Homme.
Nous demandons donc respectueusement à votre gouvernement qu'il insiste sur ces éléments essentiels pour la résolution de l'Assemblée générale qui créera le Conseil des droits de l'Homme.
