EGYPT: SCC backs divorced women's right to custody till the child is 15 years (Arabic)

Summary: Egypt's Supreme Constitutional Court stated that its for the child's best interest to give mothers the right to custody till the child is 15 years old. After that the child has the choice to stay with the mother without alimony, or to stay with the father till 21 years old, or till marriage in cases of girls.

مصر: "الدستورية العليا" تؤيد حق الأم في حضانة أطفالها حتى سن الـ 15

رفضت المحكمة الدستورية العليا، برئاسة المستشار ماهر عبدالواحد، الطعن علي الفقرة الأولي من المادة ٢٠ بالقانون رقم ٢٥ لسنة ١٩٢٩، المعدل بالقانون رقم ٤ لسنة ٢٠٠٥، والتي تنص علي انتهاء حق حضانة النساء ببلوغ الصغير أو الصغيرة سن الخامسة عشرة، ويخير القاضي بعد بلوغ هذه السن الطفل بين البقاء مع الحاضنة دون أجر حضانة، أو البقاء مع أبيه، وذلك حتي يبلغ الصغير سن الرشد، أو حتي تتزوج الصغيرة. أكدت المحكمة في حيثيات حكمها أنه صدر حرصاً علي مصلحة الصغير ودفع الضرر عنه.
