EU consultation: Access to justice in environmental matters

Summary: The European Commission has opened a public consultation on how to improve access to justice in environmental matters. It invites the general public and other interested parties to give their views on whether legislative action could improve access to justice in environmental matters across European Union Member States, and if so, what issues should such legislation address.

Contributions are sought from citizens and other stakeholders, including environmental associations, business representatives, legal professionals, the academia, national, regional and local administrations, including those dealing with courts and similar bodies

Period of consultation: From 28.06.2013 to 23.09.2013

Objective of the consultation: 

The public consultation is to seek the views of the general public and all stakeholders in order to help:

- Assess whether legislative action at EU level would have added value in ensuring effective and non-discriminatory access to justice in environmental matters across the EU Member States (subsidiarity test)

- Identify those issues where targeted EU legislative action would be needed to fulfil the objective of ensuring access to national courts in environmental matters (proportionality test)
